1. Scope

 

These General Terms and Conditions (GTC) apply to all orders placed via our online shop [www.nomoah.de] by consumers within the meaning of Section 13 of the German Civil Code (BGB).

3. Offer and conclusion of contract

 

The presentation of the products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.

By clicking the "Buy now" button, you place a binding order for the items in your shopping cart. Confirmation of receipt of your order will be sent via email immediately after you submit your order.

 

The purchase contract is concluded with our order confirmation or delivery of the goods.

 

4. Prices and shipping costs

 

All prices include VAT (where applicable) and exclude shipping costs.

The exact shipping costs will be shown to you during the ordering process.

 

5. Delivery and production time

 

Since our products are custom-made for you, delivery usually takes approximately three weeks from receipt of payment.

Deliveries will be made to the address you provide.

 

6. Payment

 

We offer the following payment methods:

– Credit card (via payment service provider)

– Other payment methods depending on technical availability

 

7. Retention of title

 

The goods remain our property until full payment has been made.

 

8. Right of withdrawal

 

Since our products are manufactured individually according to customer specifications (§ 312g para. 2 no. 1 BGB), there is no right of withdrawal.

Please take this into account when placing your order.

If something doesn't fit or is damaged, please contact us – we'll find a solution.

 

9. Warranty

 

The statutory warranty rights apply.

Since these are handmade products, slight variations in color or shape may occur. These do not constitute a defect, but are part of the individuality of each piece.

 

10. Liability

 

We are liable without limitation for intent and gross negligence. In cases of slight negligence, we are only liable for breaches of essential contractual obligations (cardinal obligations) and are limited to foreseeable damages.

 

11. Dispute resolution

 

The EU Commission provides a platform for online dispute resolution (ODR), which you can find at https://ec.europa.eu/consumers/odr/ .

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

 

12. Final provisions

 

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

Should individual provisions of these Terms and Conditions be invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
